Question: Does my friend need an attorney for this probate problem?
My friend’s husband died without a will. They have absolutely no debt. She has never contacted probate. She has a business license that can be switched to her name and grandfathered in under the old, advantageous rules only if she can show her husband died without leaving a will. She has a statement from the courthouse’s records that shows no will was ever filed. Can she file a motion in probate court by herself to get a statement from a judge regarding her right to take over the license, or must she hire an attorney?
Answer: She does not need an attorney. She can give them a sworn and notarized statement that her husband died intestate. That along with the statement from the court will be all she needs.
